ALTERNATIVE DISPUTE RESOLUTION
We feel it is important for the client to understand that a case may best be resolved prior to litigation or, if in the event of litigation, prior to trial. Although the Firm is fully equipped to take difficult cases to trial, sometimes the best result for a client is achieved through settlement, mediation or arbitration. We have extensive experience in all of the ADR forums.
Stephen M. Cohen is a former Court Judge, a certified Circuit Court and County Court Mediator in the State of Florida and has successfully mediated more than one hundred cases in the South Florida area. Additionally, Mr. Cohen has served as an arbitrator and has been appointed by local judges to serve as a Special Master in cases requiring judicial oversight of ongoing discovery disputes in litigation. This experience not only provides an additional service to the legal community but also provides the clients of the Firm a unique insight to negotiating strategies.
BUSINESS LITIGATION
The Firm represents numerous clients whose business or commercial disputes result in litigation. Representative cases involve suits over contracts, residential and commercial leases, as well as complex landlord and tenant matters. Additionally, the Firm represents policy holders whose insurance companies refuse to honor insurance agreements. In some instances, the Firm not only seeks compensatory damages, but also seeks punitive damages, if appropriate.
LANDLORD-TENANT and REAL ESTATE LITIGATION
Our knowledge and understanding of applicable residential and commercial tenancy laws allow us the insight to provide representation to either side in landlord-tenant disputes, both prior to and in litigation. The Firm also represents parties relating to real estate contract disputes. Often suits are complex and multi-party.
MOLD LITIGATION
The Firm enjoys the reputation as a leader in the representation of homeowners and tenants in claims against their builders, landlords and insurance companies for property damage and injury claims arising out of water intrusion events which cause mold intrusion.
PROBATE AND PROBATE LITIGATION
The Firm is involved in the probate of estates and the administration of trusts. All too frequently, disputes arising out of estates result in litigation and the Firm represent parties in these disputes as a regular part of our practice.
